Jail threat after builder dies in roof collapse

Man given suspended gaol sentence after worker killed in six-metre fall

A man has been given a suspended prison sentence after a construction worker was killed falling through the fragile roof of a building he was renovating in Leicester.

Robert Jozwiak, 44, died after he fell six metres from the roof onto a concrete floor fracturing his skull and back on 3 June 2009 .

Mr Jozwiak, a husband and father, was killed when the roof  made of corrugated asbestos cement sheets gave way beneath him.

Musa Suleman, 56, who had instructed him to do the work was given a 12 month prison sentence suspended for two years at Leicester Crown Court. He was also ordered to pay compensation of £13,800 to Mr Jozwiak’s family and costs of £17,337.

The court found Mr Suleman, of Freeman Road North, Leicester, had failed to ensure the work was properly planned, supervised or carried out safely.

Health and Safety Executive inspector Karl Raw said: “Safe routes and protective equipment should have been in position to allow Mr Jozwiak to get to work areas without injury, and measures to prevent or mitigate any falls should have been in place.”
